Terms of Service

These Terms of Service (“Terms”) govern your use of the Barracoder website and services provided by Barracoder (“Barracoder,” “we,” “our,” or “us”).

By accessing our website or engaging our services, you agree to these Terms.

Services

Barracoder provides cybersecurity consulting, penetration testing, vulnerability assessments, security research, and related professional services.

Specific deliverables, timelines, pricing, and scope of work may be defined separately in written agreements, proposals, statements of work (“SOW”), or engagement documents between Barracoder and the client.

Authorized Security Testing

Clients engaging Barracoder for penetration testing or security assessments represent and warrant that they have proper authorization to grant Barracoder access to the systems, applications, networks, or environments included within the agreed scope of testing.

Barracoder will perform testing only within the authorized scope defined by the client.

Unauthorized testing requests will be refused.

Client Responsibilities

Clients agree to:

  • Provide accurate and complete information necessary for the engagement
  • Obtain all required internal approvals and permissions
  • Provide authorized access credentials when necessary
  • Maintain backups of systems and data prior to testing
  • Promptly communicate any operational concerns or restrictions

Clients remain responsible for their own systems, infrastructure, configurations, and operational decisions.

Credential Handling

Where applicable, clients may provide temporary or test credentials to facilitate authorized assessments.

Barracoder will:

  • Use credentials solely for the approved engagement scope
  • Restrict credential access to authorized personnel
  • Handle credentials confidentially
  • Delete, revoke, or destroy credentials following completion of the engagement whenever reasonably possible

Confidentiality

Barracoder treats client information, assessment findings, and security-related materials as confidential.

Unless otherwise required by law:

  • We will not publicly disclose client vulnerabilities or sensitive information without authorization
  • We will not share confidential engagement details with third parties except as necessary to provide services

Clients are similarly responsible for protecting Barracoder proprietary methodologies, reports, and materials.

No Guarantee of Security

Cybersecurity assessments reduce risk but cannot eliminate all security vulnerabilities or guarantee protection against future attacks, breaches, or incidents.

Barracoder does not guarantee that:

  • all vulnerabilities will be identified
  • systems are fully secure
  • future compromises will not occur

Limitation of Liability

To the maximum extent permitted by law, Barracoder shall not be liable for:

  • indirect or consequential damages
  • business interruption
  • lost profits
  • data loss
  • security incidents occurring before or after an engagement
  • client misuse of deliverables or recommendations

Barracoder’s total liability arising from any engagement shall not exceed the total amount paid by the client for the applicable services.

Third-Party Services

Our services may involve interaction with third-party systems, platforms, hosting providers, or software. We carefully evaluate the third-party tools and providers we work with; however, Barracoder cannot guarantee and is not responsible for the availability, security, or performance of third-party services outside our direct control.

Intellectual Property

Unless otherwise agreed in writing:

  • Barracoder retains ownership of its methodologies, tools, templates, processes, and proprietary materials
  • Clients retain ownership of their systems, data, and environments
  • Clients may use delivered reports internally for security remediation and compliance purposes

Website Use

You agree not to:

  • misuse the website
  • attempt unauthorized access
  • interfere with website operations
  • use the website for unlawful purposes

Termination

Either party may terminate services in accordance with any applicable written agreement or statement of work.

Barracoder reserves the right to refuse or discontinue services for unlawful, abusive, or unauthorized activities.

Changes to These Terms

We may update these Terms periodically. Continued use of our website or services after updates constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and interpreted under the laws of the applicable jurisdiction in which Barracoder operates, without regard to conflict of law principles.
